ORDINANCE NO.677

An Ordinance by the Mayor and Board of Alderman of the City of Long Beach, Mississippi to amend Ordinance No. 588; Sec. 12-2(b) of the Long Beach Code of Ordinances establishing a variance to the fees based on application and determination of indigency.

WHEREAS, the current ordinances authorize the sale of cemetery land internment lots and sets fees associated with same.

WHEREAS the Governing body does find that a variance to fees based upon indigency may be available to Long Beach residents through an application process subject to review and disposition by the Board of Aldermen on a case-by-case basis.

BE IT ORDAINED, by the Mayor and Board of Aldermen of the City of Long Beach, Mississippi that Section 12-2(b) of the Long Beach Code of Ordinances is amended as follows:

Sect. 12-2(b). Price; option to purchase additional sites.

“The price of each internment site shall be $1500.00. Multiple internment sites shall be sold throughout the remainder of the cemetery requiring the purchase of a minimum of two internment sites and a maximum of eight internment sites. A variance to the aforementioned fees based upon indigency may be available to Long Beach residents through an application process subject to review and disposition by the Board of Aldermen on a case-by-case basis. Determination of eligibility is not to be considered as precedent setting and is derived from information in each individual application.”

This ordinance shall take effect and be in force thirty (30) days after its adoption, publication and enrollment thereof as provided by law.

The above and foregoing Amendment to Ordinance Sect. 12-2(b) was introduced by Alderman McGoey who moved its adoption. Alderman McCaffrey seconded the motion to adopt the Ordinance, and after discussion, the question being put to as roll call vote, the result was as follows:
